Feedback needed for NSW draft bill on design & building

Fair Trading NSW is seeking feedback on a draft of the proposed Design and Building Practitioners Bill 2019 and has released a draft of the Bill which delivers on reforms committed by the NSW Government in response to the Building Confidence Report written by Professor Peter Shergold AC and Ms Bronwyn Weir. The draft Bill will introduce new reforms to improve design documentation quality and compliance, and to strengthen accountability across the design, building and construction sector.

Parts of the reform will be prescribed and finalised by the supporting regulation, once developed.

When the Act and regulation commence, it is intended that the reforms will apply to certain categories of regulated designs and to multi-unit and multi-storey residential apartment buildings, which will be set out in the regulation.

Other classes of buildings are intended to be included in the new scheme in regulation over time.

The NSW Government will introduce a final Bill to NSW Parliament by the end of 2019, with further work on regulation development and consultation in 2020.

Feedback will be analysed and further amendments made where appropriate.
